ORDINANCE 520

 

AN ORDINANCE AMENDING SECTION 14-203 OF THE NORRIS ZONING ORDINANCE BY DELETING AND ADDING DEFINITIONS PERTAINING TO BUILDING SETBACK LINES AND PROPERTY LINES.

 

 

            WHEREAS, definitions pertaining to building setback lines and property lines are somewhat vague making interpretation of the zoning ordinance difficult for the Planning Commission and Board of Zoning Appeals; and

 

            WHEREAS, the Norris City Council may, in accordance with Section 13-7-204 of the Tennessee Code Annotated, amend the Norris Zoning Ordinance; and;

 

            WHEREAS, the Norris Municipal Planning Commission has explored this issue and has forwarded its recommendation to the Norris City Council;

 

            NOW THEREFORE BE IT ORDAINED by the City Council of the City of Norris, Tennessee:

 

            Section 1.  Section 14-203. Definitions is hereby amended by deleting the following:

 

BUILDING SETBACK LINE, FRONT: A line delineating the minimum allowable distance between the street right-of-way, or of an official future street right-of-way line, and the front of a building on a lot.  The front building setback line extends the full width of the lot and is parallel to, or concentric with the street right-of-way.

 

BUILDING SETBACK LINE, REAR: A line delineating the minimum allowable distance between the rear property line and a building on a lot (other than for permitted accessory structures).  The rear setback line extends the full width of the lot.

 

BUILDING SETBACK LINE, SIDE: A line delineating the minimum allowable distance between the side property line and a building on a lot.  The rear setback line extends the front building setback line to the rear building setback line.

 

LOT, LINES: The boundary dividing a given lot from the street, an alley, or adjacent lots.

 

            Section 2.  Section 14-203. Definitions is hereby amended by adding the following:

 

PROPERTY LINE:  The boundary dividing a given lot from the street, and alley, or adjacent properties.


PROPERTY LINE, FRONT:  A line, or lines, designating the road right-of-way/property line(s) from which a property is addressed; or for flag lots or similar lots served by an easement, the front property line is the interior property line(s) most parallel and closest to the street right-of-way from which the lot is addressed.

 

PROPERTY LINE, REAR:  A line, or lines, most opposite and most parallel to the front property line(s).  Triangular or other irregularly shaped lots may not have a rear property line.

 

PROPERTY LINE, SIDE:  Any property line that is not a front or rear property line.

 

BUILDING SETBACK LINE, FRONT:  A line, or lines, parallel to a front property line, or lines, designating the minimum distance from the front property line(s) in which a building can be located.  The front building setback line extends the full width of the lot.

 

BUILDING SETBACK LINE, REAR:  A line, or lines, parallel to a rear property line, or lines, designating the minimum distance from the rear property line(s) in which a building can be located.  The rear building setback line extends the full width of the lot.

 

BUILDING SETBACK LINE, SIDE:  A line, or lines, parallel to a side property line, or lines, designating the minimum distance from the side property line(s) in which a building can be located.  The side setback line extends from the front building setback line to the rear building setback line.

 

Section 3.  This Ordinance shall become effective from and after its passage, the public welfare requiring it.
