BE IT REMEMBERED THAT THE CITY OF NORRIS CITY COUNCIL MET IN REGULAR SESSION ON MONDAY, JANUARY 13TH, 2014, AT 7:00 P.M. WITH THE FOLLOWING COUNCIL MEMBERS PRESENT: JACK BLACK, BILL GRIEVE, YORK HAVERKAMP, CHRIS MITCHELL, AND LORETTA PAINTER.

 

 

The meeting was called to order by Mayor Chris Mitchell.

APPROVAL OF MINUTES

1.      The minutes of the December 9th, 2013 meeting were presented for approval. Motion was made by Vice Mayor Black to approve the minutes.  Motion was seconded by Council Member Painter. Motion carried by voice vote.

 

OLD BUSINESS

 

2.      Mayor Mitchell made a motion to appoint Joe Deatherage to the BZA Board and Katrina Buckley to the Norris Little Theatre Board.  Motion was seconded by Council Member Haverkamp.  Motion carried by voice vote.

 

3.      Auditor Jami Kiger with HG & A Associates presented to council the 2013 CAFR.   She reported the independent auditor's report expresses a clean audit - unqualified opinion - with no findings. She gave a brief overview of the audit and fund balance.   She reported the City had received the GFOA Award for Financial Reporting for nine consecutive years. Ms. Kiger also reported the CAFR has been submitted to the state.  Ms. Kiger stated the audit went smoothly and she thanked the Mayor, Council, City Manager, City Recorder, and the office staff for their assistance during the audit.   Mayor Mitchell noted the current trend is the City is getting healthier each year.

 

Vice Mayor Black stated on behalf of residents on Dairy Pond Rd. and others, he wanted to talk about the speeding issue.  He noted there were 22 citations for speeding issued over a one week period in December 2013.  He stated if it was that easy to give that many citations during that short period of time, than we do have a speeding problem that needs to be looked at.    Vice Mayor Black asked about the status of the radar monitoring equipment.   City Manager Hester reported it had not been ordered due to a price change that he would discuss with Council.

 

4.      City Manager Hester stated Council had approved last month the purchase of radar equipment to monitor and count traffic in Norris in the amount of $2,000.00.   City Manager Hester reported the $2,000.00 was only for the radar equipment and did not include the necessary software.    The true cost of the equipment and software will be approximately $4,500.00.  City Manager Hester requested approval of an additional $2,500.00 for the purchase of the equipment and software  Motion was made by Vice Mayor Black to approve the additional $2,500.00 from cash reserve for the purchase of the equipment and software.  Motion was seconded by Council Member Grieve.  Motion carried by voice vote.

 

5.      The US Cellular Cell Tower Rental Proposal was presented by City Manager Hester.  The current lease will expire 09/11/14 and US Cellular would like to sign a new lease.   The US Cellular lease would be for a total of twenty-five years.  The lease payment would be $1,200 per month with an increase of 10% every five years or the CPI, whichever is greater. Motion was made by Council Member Haverkamp to accept the proposed overview.  Motion was seconded by Vice Mayor Black.  Motion carried by voice vote.

6.      CITY MANAGER REPORT

 

City Manager Hester reported on the following:

 

1)      The 2013-2014 budgets are on track with revenue slightly ahead of budget and expenditures tracking to budget.

2)      Grant Updates - The City should be submitting a Parks and Recreation Grant later this spring.  He also reported the Home Grant Program would be available later this year.

3)      Dump Truck Clutch Repair.  The City dump truck has been in the shop for six weeks and was finally repaired at a cost of $2,300.  In the future, the City will look at other sources for repair work.  As a result of the truck being in the shop, leaf pickup is behind schedule, but Public Works has started leaf pickup again.

4)      Public Safety Staffing Change.  Reported Public Safety Officer Ronnie Foust submitted his resignation effective 12/31/13.   City Manager Hester reported offers have been made to two Post Certified Officers.  

5)      New Public Safety Vehicle status.    New 4 x 4 Dodge truck has been delivered and is now

in service. 

6)      City Manager Hester reported no change in annexation challenge from last month.  He is anticipating the appeal to be heard later this calendar year.

NEW BUSINESS

 

7.       Budget Amendments - None

8.      The Red Ribbon Month Proclamation was presented by City Manager Hester.    The City is declaring January as Red Ribbon Month in Norris and encourages all citizens, businesses, public and private agencies, media, religious and education institutions to wear and display red ribbons.  Motion was made by Council Member Grieve to approve the Proclamation.  Motion was seconded by Council Member Painter.  Motion carried by voice vote.

9.      Ordinance 572 Amending the Norris Zoning Code by Adding Provisions for Temporary Storage Containers was presented for first reading.  City Manager stated this is a recommendation of the Norris Planning Commission.  Motion was made by Council Member Grieve to approve the first reading of Ordinance 752.  Motion was seconded by Council Member Painter.  Motion carried by voice vote.

10.  City Manager Hester recommended the Public Hearing for Ordinance 572 be held on Monday, February 10th at 6:30 p.m.  Motion was made by Council Member Grieve to approve the Public Hearing on February 10th, 2013 at 6:30 p.m.  Motion was seconded by Council Member Painter.  Motion carried by voice vote.

11.  City Manager Hester presented the Norris Water Commission Sewer Back up Policy for approval.  Norris Water Commission adopted this policy by unanimous vote at their December 18th, 2013 meeting.  City Manager Hester stated City Council must approve any policy of Norris Water Commission.   This policy is intended to provide customers with information to assist them in preventative action, and to outline procedures should a backup incident occur.  Customer notices will be mailed to all current NWC sewer customers and will also be given to all new customers.  Motion to approve the Sewer Back up Policy was made by Vice Mayor Black.  Motion was seconded by Council Member Grieve.  Motion carried by voice vote.

Accounts Payable, Minutes, and Reports

Mayor Mitchell asked Council for questions or comments concerning accounts payable, minutes, and reports - there was none.

12.  Motion was made by Council Member Grieve to adjourn.  Motion was seconded by Council Member Painter.  Motion carried by voice vote at 8:16 p.m.

  1. 2013-14 Year to Date (Estimated through December) Budget.   Revenues & Expenditures are tracking to budget:
  • All revenues and expenditures are on target to budget.
  • Final Year End numbers for Fiscal Year 2012-13 are now available and are available for review. The City finished the 2012-13 budget year with 100% of planned City services and Capital projects funded, and an increase in Undesignated CASH reserves.

2012-13 Year End Undesignated CASH reserves are estimated @:

o        General Fund      $135,000

o        Watershed            $129,000

Overall, the City's financial health continues to be very strong.

  1. Grant Updates.

There are no active city grants currently. 

  1. Dump Truck Clutch Repair.  The City dump truck has had the clutch replaced at a cost of $1,700 $2,325.   An additional part (flywheel) had to be purchased above the original quote.  The repair work took 5+ weeks to complete, which is the reason the City is behind on leaf collection.   We will seek other repair sources for future work.   

 

  1. Public Safety Staffing Change.  I am sorry to report that Public Safety Officer Ronnie Foust has submitted his resignation effective December 27.   Ronnie has decided to leave law enforcement and take a job in the private sector.  We wish Ronnie the best in this move.  Chief Humphrey and I have interviewed several potential candidates for the two open positions, and have extended offers to two people.  We expect these individuals to join the Norris Public Safety Department within the next 30 days, and I will report further on this at the February Council meeting.

 

  1. New Public Safety Vehicle Status.     Vehicle arrived and is in service.    We greatly appreciate that we have the ability to keep our City personnel properly equipped!  

 

  1. Annexation Updates.  Chancellor Lantrip signed orders October 1, 2013 regarding his decision to dismiss the annexation in favor of the plaintiff, Mark Garrett.   City Attorney Pratt is preparing a motion to appeal.   The Notice for the Motion to Appeal was filed in October 31, 2013.
