ORDINANCE 567

 

AN ORDINANCE TO AMEND TITLE 14, PLANNING & ZONING, SECTION 14-422, ADDITION OF STANDARDS FOR PUBLIC STREETLIGHT ADDITIONS AND REMOVAL.

 

WHEREAS, the City Council of Norris, Tennessee is vested with the authority under Tennessee Code Annotated, Section 13-7-204 to adopt and amend the zoning ordinance and map of the municipality; and

 

WHEREAS, pursuant to Tennessee Code Annotated, this amendment to the Norris Zoning Ordinance has been reviewed and recommended by the Norris Municipal Planning Commission;

 

NOW THEREFORE, BE IT FINALLY ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORRIS, TENNESSEE that:

 

Section 1.            The following be added in its entirety to existing section 14-422:

 

14-422-2    Street Lighting.

 

Light fixtures Configuration.   Street light fixtures shall be installed and maintained on public rights of way in accordance with Clinton Utility Boards standards and regulations as governed by TVA with placement determined in conjunction with an agreement between CUB and the City of Norris.

 

RESIDENT REQUESTS FOR ADDITIONAL STREET LIGHTING OR REMOVAL OF EXISTING STREET LIGHTING:

 

Additional streetlights, mounted on existing local utility owned utility poles may be requested by residents where street lighting does not exist on public roadways within the City of Norris. Residents may also request that an existing streetlight be removed. 

 

Requests to add a streetlight will be reviewed and approved, or denied, based upon the following applicable street lighting policy criteria guidelines:

  • There is an existing CUB owned utility pole at the requested location.
  • The added light is located on a public right of way for the purpose of vehicle/pedestrian safety with particular consideration given to the following locations:
    • Public roadway intersections
    • Pedestrian crosswalks
    • Public parking lots.
    • Locations where there are no streetlights within 400 feet of an existing streetlight other than at intersections or crosswalks.
    • Road conditions, which are deemed potentially hazardous such as curves or other topographical changes within areas, which limit site line visibility.
    • Areas with high nighttime traffic accident history (per Police/Fire Dept.)
    • -Areas of heavy pedestrian traffic, such as public or community buildings (schools, community centers et.)
    • The location is not located on private property.
    • There is sufficient electric equipment and pole space clearance available at the requested location for the addition of a streetlight.
  • The new streetlight request is agreeable by all property owners abutting the light location who are potentially affected by "spillover" from the light. Signatures of affected abutters are required.
  • A private individual, or organization, may request a light providing they assume the costs for the installation and monthly charge associated with the addition of the light. Affected abutters must also approve of this light.

 

Requests to remove a streetlight will be reviewed and approved, or denied, based upon the following applicable street lighting policy criteria guidelines:

  • The light is not located on a public right of way for the purpose of vehicle/pedestrian safety with particular consideration given to the following locations:
    • Public roadway intersections
    • Pedestrian crosswalks
    • Public parking lots.
    • Road conditions, which are deemed potentially hazardous such as curves or other topographical changes within areas, which limit site line visibility.
    • Areas with high nighttime traffic accident history (per Police/Fire Dept.)
    • Areas of heavy pedestrian traffic, such as public or community buildings (schools, community centers et.)
    • The location is not located on private property.
  • The streetlight removal request is agreeable by all property owners abutting the light location who are potentially affected by the removal of the light. Signatures of affected abutters are required.
  • A private individual or organization, may request a light to be removed, providing they assume the cost of such removal. Affected abutters must also approve of this removal.

 

SECTION 2:  This ordinance shall take effect and be in force from and after its approval as required by law.
