BE IT REMEMBERED THAT THE CITY OF NORRIS CITY COUNCIL MET IN REGULAR SESSION ON MONDAY, MARCH 11TH, 2013, AT 7:00 P.M. WITH THE FOLLOWING COUNCIL MEMBERS PRESENT: JACK BLACK, BILL GRIEVE, YORK HAVERKAMP, CHRIS MITCHELL, AND LORETTA PAINTER.

 

The meeting was called to order by Mayor Chris Mitchell.

APPROVAL OF MINUTES

1.       The minutes of the February 11th, 2013 meeting were presented for approval. Motion was made by Council Member Haverkamp to approve the minutes.  Motion was seconded by Council Member Grieve.  Motion carried by voice vote.

 

OLD BUSINESS

 

2.       Mayor Mitchell made a motion to appoint Al Fletcher to the Recreation Commission.  Motion was seconded by Vice Mayor Black.  Motion carried by voice vote.

 

3.       Ordinance 563 - An Ordinance of the City of Norris, Tennessee Adding Mechanical Inspections, Part V, As Defined By the 2006 Edition of the International Building Code, Residential Code, and Plumbing Code was presented for second reading.   Motion was made by Council Member Grieve to approve the second reading of Ordinance 563.  Motion was seconded by Council Member Painter.  Motion carried by voice vote.  

 

4.       Ordinance 564 - An Ordinance to Amend Title 17, Refuse and Trash Disposal, Chapter 1 Refuse, Section 17-107, Refuse Collection Fees was presented for second reading.   City Manager Hester noted the current contract runs through June, 2015 and the projected rates should hold until June 2015.  City Manager Hester also noted a Public Hearing was held at 6:00 p.m. before the council meeting.  City Manager Hester recommended adoption of Ordinance 564.  He also noted a notice of the rate increase will be mailed to all customers in April 2013.  The rate increase will be effective on the May  2013 billing.  Motion was made by Vice Mayor Black to approve the second reading of Ordinance 564.  Motion was seconded by Council Member Haverkamp.  Motion carried by voice vote.

 

5.       The Revised Lighting Standard Ordinance was presented for review and discussion.  Council Member Haverkamp said he felt this is a progressive ordinance that will be manageable.   City Manager Hester stated the revised ordinance adds reference to churches and schools and also the section pertaining to street lights includes the removal of street lights.  Spencer Boardman, Chairman of the Planning Commission, stated the Commission had taken the development of the lighting ordinance seriously and it would be prudent for the council to approve the ordinance.   Motion was made by Council Member Haverkamp to approve the Revised Lighting Standard Ordinance on first reading.  Motion was seconded by Vice Mayor Black.  The vote of the first reading of the Ordinance was as follows:  Voting for:  Council Member Haverkamp and Vice Mayor Black.  Voting against:  Council Member Grieve, Council Member Painter, and Mayor Mitchell.  Motion failed.

 

6.       Mayor Mitchell recommended adding Section 14-422-9 of the Proposed Revised Lighting Standard Ordinance to the City's current code on first reading.  The motion to add section 14-422-9 to the City's current code was made by Mayor Mitchell.  Motion was seconded by Vice Mayor Black.  Motion carried by voice vote.

 

CITY MANAGER REPORT

 

City Manager Hester reported on the following:

 

1)       The 2012-2013budgets are on track.  Property tax collection is 98.5%.  Expenditures are on track as of 02/28/2013.

2)       No update on the Archives Grant.

3)       The dates for Spring clean-up are April 8-12, 2013.

4)       City Manager Hester announced Discover Norris will be Saturday, March 16th from 2-5 p.m.

5)       City Manager Hester reported the Norris Volunteer Fire Department will be holding a barbeque dinner fundraiser on Saturday, March 16th at 6 p.m. at the community center.  Tickets are $12 in advance and $15 at the door.  Proceeds from the fundraiser will be used for training expense and to purchase equipment.

6)       City Manager Hester reported the challenge pertaining to Annexation Ordinance 545 will be heard in Anderson County Chancery Court on May 29 and 30, 2013.

NEW BUSINESS

 

7.        City Manager Hester presented the 2013-2014 Budget Calendar for approval. Motion was made by Council Member Grieve to approval the 2013-2014 Budget Calendar.  Motion was seconded by Council Member Painter.  Motion carried by voice vote.

8.        City Manager Hester presented a letter to the Comptroller of the Treasury, Office of State and Local Finance for approval.  The letter was pertaining to the one audit finding in the 2011-2012 Comprehensive Annual Financial Report pertaining to the negative fund balance in the State Street Aid Fund Balance.   The letter explains the error and details the corrective action.  Motion was made by Vice Mayor Black to approve the letter.  Motion was seconded by Council Member Grieve.  Motion carried by voice vote.

9.       Ordinance 565, An Ordinance Amending the Zoning Map of the City of Norris, Tennessee, by Zoning Parcel 043 024.00 as C-2: General Commercial District was presented for first reading.  Motion was made by Council Member Painter to approve the first reading of Ordinance 565.  Motion was seconded by Council Member Grieve.  Motion carried by voice vote.

10.    Ordinance 566, An Ordinance Amending the Zoning Map of the City of Norris, Tennessee, by Zoning Parcel 043 023.00 as C-2: General Commercial District was presented for first reading.  Motion was made by Vice Mayor Black to approve the first reading of Ordinance 566.  Motion was seconded by Council Member Painter.  Motion carried by voice vote.

11.    City Manager Hester noted Public Hearings for Ordinances 565 and 566 and the addition of 14-422-9, Street Lighting, to the City of Norris Code would need to be scheduled.   City Manager Hester recommended the Public Hearings be held on April 1st, at 6:00 p.m. for Ordinances 565 and 566 and 6:30 p.m. for the Street Lighting addition.   Motion was made by Mayor Mitchell to approve the April 1st, 2013 date for the Public Hearings.  Motion was seconded by Council Member Grieve.  Motion carried by voice vote.

12.    City Manager Hester presented a budget amendment request from the Watershed Commission.  The purpose of the amendment is to purchase GIS software for the forestry consultant at a cost of $1,500. City Manager Hester noted there are available funds in the Watershed Fund Balance.  Mayor Mitchell would like a review of the Watershed funds as part of this year's budget process.  Motion was made by Council Member Haverkamp to approve the $1,500 budget amendment.  Motion was seconded by Council Member Grieve.  Motion carried by voice vote.

13.    Resolution 1-2013, A Resolution to Establish an Updated Occupational Safety and Health Program Plan, Devise Rules and Regulations, and to Provide for a Safety Director and the Implementation of Such Program Plan was presented for approval.  City Manager Hester recommended approval of the resolution in order for the city to be TOSHA compliant.  Motion by made by Vice Mayor Black to approve Resolution 1-2013.  Motion was seconded by Council Member Grieve.  Motion carried by voice vote.

City Manager Hester reported on an update from Public Safety Chief Danny Humphrey.  A new weather alert system is now available in Norris.  The Anderson County E-911 office has opened their new website and have released a new feature called eAlert.  This will be a weather warning and county wide warning system for alerts in Anderson County.  This system will be free to citizens that are in the Anderson County E-911 District.  Information can be obtained at www.ace911.net  or 865/463-8160.

RE:                   City Manager's Report

 

  1. 2012-13 Year to Date (Estimated through February) Budget.   Revenues are tracking to budget:
  • ~98.5% of property tax collected
  • 69% of estimated Local/State sales tax, beer, and wholesale liquor tax collected, which is slightly ahead of budget

Expenditures are on track to budget, with 70% of budgeted expenses paid through the end of February. 

 

  1. Grant Updates.
    1. Archives Grant.  An application has been submitted to the State.  This grant would fund the purchase of metal shelving and supplies for the Archives located in the museum section of the McNeeley Building.

 

  1. Annual Spring Clean up.   Dates have been set for April 8-12 for the annual clean up.  The City will pick up objects at curbside that are not too heavy for two men to handle.  Items that cannot be picked up are tires, paint or solvents, unused cleaning supplies, freezers or refrigerators, building materials, or anything with asbestos.

 

  1. Discover Norris. The Norris Community Development Board is hosting a second annual "Discover Norris" event on March 16 at the Norris Community Building Gym.  The purpose of "Discover Norris" is to provide an orientation to the Norris community for new residents to the area.  Discover Norris will be a drop-in event from 2 - 5 pm. 

 

  1. Norris Volunteer Fire Department fundraiser, Saturday March 16, 2013; 6pm.   BBQ pork or chicken dinners will be served, and live music will be provided by local artists at the Norris Community Building gym.   Advance tickets are available at Norris Public Safety for $12.00.   Tickets will be available at the door for $15.00.   Proceeds will be used to update the 1991 First Responder Truck.    While the City strongly supports our Volunteer Department with funding and other resources, contributions are needed to help keep the volunteer department fully equipped so they can continue providing invaluable community services.

 

  1.  Annexation Updates.   Court dates have been set to hear the challenge brought in regard to Annexation Ordinance 545.   Dates are Wednesday May 29, 2013 and Thursday May 30, 2013.
