BE IT REMEMBERED THAT THE CITY OF NORRIS CITY COUNCIL MET IN REGULAR SESSION ON AUGUST 22, 2011 WITH THE FOLLOWING COUNCIL MEMBERS PRESENT: JACK BLACK, TOMMY MARINER, CHRIS MITCHELL, LOY JOHNSON AND JOY WILSON

HEAR THE PUBLIC

Joseph Minerik from St. Francis Episcopal Church would like to have a pet memorial garden close to the Church.  Mr. Minerik has done research and asks permission to use this land back behind the church.  This is a parcel that belongs to the city and it is a flood plan and sink hole.  City Manager said there is no need for City's use.  Joe would like to just use.  Tommy Mariner would like to sale this piece of land or swap lands.  This land is 20ft square.  Chris Mitchell Request to think about it and research and get back next month.

Kathy Sarvis concerned with the liquor store.  How is the process going?  City Manager Hester states that people have 6mths to complete their application by state.  Others have interests in this. 

MINUTES

1.  Council Member Joy Wilson moved to accept the corrected Council Minutes from July 11, 2011 and July 25, 2011 as stated.  Seconded by Council Member Jack Black.  Motion carried by voice vote.

 

NEW BUSINEES

Lynn Chilcoat, from Anderson County came to present Resolution No. 8-2011 to adopt the Anderson County Multi-Jurisdictional Hazard Mitigation Plan for adoption. 

The Anderson County Commission July 28, 2011 approved the plan. 

Tommy Mariner has issues with this adoption process.  Specifically on page 21 of the hand book, where it states putting sprinklers in residential homes. This is not good practice. 

Ms. Chilcoat states the City could modify the mitigation plan that is coming from the County.  You would need to modify in section 9 of this plan.  The City Council would like to look at and bring back to council next month.  The Cities that have adopted thus far are Lake City and Clinton.   

 

OLD BUSINESS

No update on Boards and Commission Vacancies

 

Discussion was made on Ordinance 531 AN ORDINANCE ANNEXING TERRITORY AND INCORPORATING SAID TERRITORY INTO THE CORPORATE LIMITS OF THE CITY OF NORRIS, TENNESSEE.   Mr. Hester advised that the property owner, Jon Dunn, had agree to give consent and any contest to same if the City would agree to not take over inspection services for a 24 month period, and that the existing site plan already submitted and approved by the County would not be modified by the City of Norris.

 

2. Council Member Tommy Mariner makes a motion to approve the City Attorney to write an agreement and have the City Mayor sign it for approval.  Seconded by Council Member Joy Wilson.  Voting Aye: Jack Black, Tommy Mariner, Chris Mitchell and Joy Wilson.  No: Loy Johnson.  Motion passes. 

The City Council will table Ordinance 531 and 532 until an agreement with Mr. Dunn can be signed. 

 

City Manager Hester would like to recommend to look at on 1st reading new Ordinance 541, to clarify that the current annexation action presented in Ordinance 531 is to include parcel 032 037.02. 

3.  Council Member Tommy Mariner makes a motion to pass on first reading a New Ordinance 541.  Seconded by Council Member Joy Wilson.  Motion carries by voice vote. 

 

City Council delayed the second reading of Ordinance 533 until Ordinances 531, 532, and 541 are also considered.

City Manager Recommendation to accept the lowest bid on the LPRF Grant

4. Council Member Tommy Mariner moves to accept lower bid for the LPRF Grant.  Seconded by Council Member Jack Black.  Motion carries by voice vote. 

 

Potential Options for Planning Services

For more detail please see City Manager Report attached. 

Mr. Hester asks Council to approve in principle Anderson County Planning and Mapping Services for a period of 1 year.

5.  Council Member Tommy Mariner makes a motion to approve use of Anderson County Planning and Mapping Services in principle.  Seconded by Council Member Jack Black.  Motion carries by voice vote. 

 

AYSOAGREEMENT BETWEEN THE CITY OF NORRISAND THE AMERICAN YOUTH SOCCER ORGANIZATION REGION 796 FOR THE USE OF THE NORRIS COMMONS

6. Council Member Tommy Mariner makes a motion to approve AYSO agreement with the City of Norris.  Seconded by Council Member Loy Johnson.  Motion carries by voice vote. 

Discussion was made by City Manager Hester to approve Street Paving.

7.  Council Member Joy Wilson makes a motion to approve the Street Paving.  Seconded by Council Member Jack Black.  Motion carries by voice vote. 

MTAS Model Debt Policy, Cities Must Adopt Policy by December 31, 2011

In December 2010, the Tennessee State Funding Board adopted a statement on debt management directing governmental entities in Tennessee to draft and adopt their own debt management policies no later than December 31, 2011. You should begin the process now to develop and adopt a debt management policy designed to meet your community's needs. MTAS has developed a model debt policy that establishes parameters by which municipalities should undertake debt obligations.

City Council would like to look at Debt Policy and return next meeting for discussion. 

Mr. Hester introduces Ordinance 540 to clarify Norris boundaries on Hwy 61.

14.  Council Member Tommy Mariner makes a motion to adopt on first reading Ordinance 539.  Seconded by Council Member Jack Black.  Motion carries by voice vote.

 

City Manager Hester recommends scheduling Monday October 10, 2011 at 5pm a Public Hearing with specific comments, specific ordinances and specific property just for clarity for ordinances 541, 534, 536, 535, 537, 538, 539, and 540.

15.  Council Member Loy Johnson makes a motion to schedule a public Hearing Monday October 10, 2011.  Seconded by Council Member Jack Black.  Motion carries by voice vote.  Loy Johnson was absent.

RE:                           City Manager's Report

 

1.        2010-11 Year to Date (Estimated through June) Budget.   Final numbers will be available by end of August and will be reviewed at the September Council meeting.

2.        2011-12 Year to Date (Estimated through July) Budget.   Revenues and Expenditures on track to budget.

3.        Grant Updates

a.        EECBG.    All contracted upgrades have been completed.  Public Works will complete various lighting upgrades to complete work on this grant.     

b.        TEA-21 Sidewalk Grant.   Project is on target to complete by early September. 

c.        LPRF Grant.  Bids for playground equipment were opened on August 12.  Recreation Brands Group submitted the lowest bid for $19,824.68.   The State now needs to approve the bid.   Once approved, Council will need to approve a contract with the winning bidder.  Work will now continue with the development of a budget for remaining items such as fencing and parking.

d.        FEMA Grants.   County funds for the fire truck have been received.  Final specifications are being reviewed.  Once this is done a contract can be signed.   Estimated lead-time on delivery of the truck is 6 months.

4.        New office computers and printer.  The city office now has 3 new computers and a wireless printer.   This is the result of an anonymous cash donation of $4,500!   Thanks to all of those in Norris who contribute so generously to their community.

5.        Update on Potential Options for Planning Services.   Different options are:

a.        Use consultant services from former LPO staff.   David Williams notified me last week that he has accepted a job with TDOT and was no longer interested in consulting work.   This option also did not provide for a mapping resource.

b.        Use existing Anderson County Planning and Mapping Services.   The proposed fee structure is:

a.        $750 base fee for continuing education and materials

b.        $25 per hour for planning and GIS functions

c.        All GIS and planning documents will be provided in digital format.

Estimated annual cost with Anderson County is $3,750.00

c.        Use newly developed resources as provided by the East Tennessee Development District (ETDD).    Most recent feedback from ETDD:

d.        Staffing will be in place by September 1

e.        ETDD will hire a GIS technician

f.         Since this is a new venture for ETDD, ETDD will be carefully tracking the costs over the course of the upcoming year. Once ETDD gets a better handle on the costs they will begin discussion with local communities regarding the costs to renew their contracts.

g.        Initial cost will be the same as the previous City of Norris contract with LPO: $5,250 per year.

I recommend that City Council approve in principle to contract with Anderson County for Planning services for a 1-year period.    With such approval, a formal Interlocal Agreement can be drafted by the County and would be subject to Council approval at a future date.
