BE IT REMEMBERED THAT THE CITY OF NORRIS CITY COUNCIL MET IN REGULAR SESSION ON MAY 9, 2011 WITH THE FOLLOWING COUNCIL MEMBERS PRESENT: JACK BLACK, TOMMY MARINER, CHRIS MITCHELL, LOY JOHNSON AND JOY WILSON

 

HEAR THE PUBLIC

Jimmie Ruttan has concerns with the City of Norris evacuation plan.  Do we have one in case of storms, tornado, flooding, etc.?  Do we have a shelter near by?   What are the ramifications of this matter? 

City Manger Hester states that we do have an evacuation plan and currently working towards a warning system to alert the residents.  The City is looking at a system and applying for a FEMA Grant.  The Shelter is through the Emergency Management (EMA), it would be going to Churches and Schools.  The knowledge of this would be announced through News Radio, and TV. 

C. A. Ridge has concerns with the City Budget needing a tax increase.  It will not personally affect himself but is concerned with lower income residents.  The food pantry has increased, prices are going up in retail, Heiskell is facing user fees and inflation, please reconsider this tax increase. 

MINUTES

1.  Council Member Tommy Mariner moved to accept the Council Minutes from April 11, 2011 for the Council meeting as written.  Seconded by Council Member Jack Black.  Motion carried by voice vote.

 

OLD BUSINESS

Boards and Commission Vacancies hold till next Council Meeting.

 

Sain Annexation cannot be scheduled this week due to not having in News article in time.  Consider Re-scheduling May 27th

 

2.  Council Member Joy Wilson makes a motion to re-schedule Sain Annexation valuation to Friday May 27, 2011 at 6:00pm for Public Hearing and 6:30pm for called Council Meeting.  Seconded by Council Member Jack Black.  Eye:  Chris Mitchell, Jack Black, Loy Johnson and Joy Wilson.  No:  Tommy Mariner.  Motion carries.  

 

City Annual Audit Review.  Discussion held on the three bids received for City Audit services.  

 

3.  Council Member Tommy Mariner makes a motion to have HG&A Associates for the Municipal Audit.  Seconded by Council Member Jack Black.  Aye:  Jack Black, Tommy Mariner and Chris Mitchell.  No:  Loy Johnson and Joy Wilson.  Motion passes.

 

CITY MANAGER REPORT

See attached Report 

4. Council Member Tommy Mariner makes a motion to approve Volunteer Mechanical for HVAC work on the Public Safety Building.  Seconded by Council Member Joy Wilson.  Motion carried by voice vote. 

 

County Mayor Myron Iwanski would like to update that the county is recruiting for countywide retail.  Mayor Iwanski will be proposing that the County and Cities would help fund this effort.   The expected cost to Norris would be between $1,000 and $2,000 per year.   More information will be available in the near future.

 

Open House May 14, 2011 10:00-12:00, for the New Norris House completed by UT Students on 143 Oak Rd. 

 

 

5.  Council Member Tommy Mariner makes a motion to accept the $271,459 bid for the Fire Truck with Heritage Truck Company, amending based on funding being available.  Seconded by Council Member Loy Johnson.  Motion carried by voice vote. 

 

NEW BUSINESS

Discussion was made on several Ordinances. 

 

6.  Council Member Tommy Mariner makes a motion to pass Ordinance 529 to repeal the existing title 18 of the Norris municipal code and to replace it with the revised title 18, as recommended by the Norris Water Commission for water and sewer service, amending with edit mass to PASS, section 18-106, and 18-203 second sentence last word CLASSES, on First reading.   Seconded by Council Member Loy Johnson.  Motion carried by voice vote.

 

7.Council Member Tommy Mariner makes a motion to pass Ordinance 526 to adopt a fee schedule for the Norris municipal code, title 18, utilities and services, schedule of charges for water and sewer service, on First reading and have public hearing June 13, 2011 5:00pm.  Seconded by Council Member Joy Wilson.  Motion carried by voice vote. 

 

Discussion ensued on budget as presented, with no reduction of City services and a proposed property tax rate of $1.63 per $100 of assessed value.

 

8.Council Member Tommy Mariner makes a motion to pass Ordinance 530 for the various funds, departments, institutions, offices, and agencies of Norris City, TN for the year beginning July  1, 2011 and ending June 30, 2012, on First reading.  Seconded by Council Member Jack Black.  Voting Aye:  Jack Black and Tommy Mariner.  No: Loy Johnson, Chris Mitchell and Joy Wilson.  Motion Failed. 

 

Joy Wilson opposes because the city still needs to consider on business next year. Concerns with maintaining funds.  Quality and services does come with a cost.  A concern with employee's not getting a cost of living raise.  Future decisions may alter.  Would like for City office to run different projection options for the budget.  

 

Options were then reviewed on how the budget ordinance could be considered further at the current meeting.   Mr. Hester asked for a 5-minute recess to review.

 

5 minute recess 9:45pm, and reconvened at 9:50pm.

 

Mr. Hester stated that Council could reconsider the budget ordinance if a member of the winning vote made a successful motion to reconsider.

 

9.  Council Member Joy Wilson makes a motion to re-consider the Ordinance 530.  Seconded by Council Member Tommy Mariner.  Motion carried by voice vote. 

 

Discussion ensued on the proposed property tax rate.

 

10.  Council Member Loy Johnson makes a motion to amend Ordinance 530, by amending the property tax rate to $1.55 as is currently and having the remaining budget revenue shortfall come from the Undesignated Fund Balance.  Seconded by Council Member Chris Mitchell.  Voting aye:  Loy Johnson, Chris Mitchell and Joy Wilson.  No:  Jack Black and Tommy Mariner.  Motion carried. 

 

11.  Council Member Joy Wilson makes a motion to pass the original budget ordinance motion with the amended $1.55 property tax rate and remaining balance from the Undesignated Fund Balance.  Seconded by Council Member Chris Mitchell.  Voting aye:  Loy Johnson, Chris Mitchell and Joy Wilson.  No:  Jack Black and Tommy Mariner.  Motion carried. 

 

12.  Council Member Chris Mitchell makes a motion for council to consider Annexation study and send to plan commission for to review a Plan of Services.  Seconded by Council Member Loy Johnson.  Voting aye:  Jack Black, Chris Mitchell, Loy Johnson and Joy Wilson.  No:  Tommy Mariner.  Motion carried. 

 

13.  Council Member Loy Johnson moved to adjourn.  Seconded by Council Member Joy Wilson.  Motion carried by voice vote.  10:15pm.

RE:                  City Manager's Report

 

  1. 2010-11 Year to Date (Estimated through April) Budget.   YTD expenditures are in line with the budget, with the exception of legal expenses associated with the annexation of property along Highway 61.     The majority of revenues are on track thus far with State Sales Tax and property taxes tracking to budget (99% of property and personal property taxes were collected through March.

 

However, total revenue does project to be approximately 3% short of budget estimations.

 

Local Option Sales tax is currently tracking ~$15,000 short of budget.  As reported earlier, the decline is partly from reassignment of revenue by the State Department of Revenue.  Property Tax collections have also fallen ~$10,000 short of budget due primarily to assessment appeals.   Other miscellaneous revenues are also tracking to be short ~$5,000.   This equals a total revenue shortfall of ~$30,000.   The City is working to mitigate ~ half of this by limiting all spending through the end of the fiscal year to essential purchases only.

 

  1. Grant Updates
    1. EECBG.    Materials have begun to arrive and work will begin in earnest in May, and the majority of upgrades should be complete by the end of the month.  Target date for completing all Grant funded projects is June 30, 2011.  

      Public Safety HVAC bid

    1. TEA-21 Sidewalk Grant.   Work has been slowed by wet weather.   However, the forming and pouring work should begin soon and will proceed quickly with drier weather conditions.  
    2. LPRF Grant.  A workshop is scheduled for May 16, 2011 @ 6:00pm to review final layout plans for the playground.
    3. FEMA Grants.
